Indiana Mortgage Closings (whether actively contacting a debtor or reporting delinquencies) is a serious endeavor. Mistakenly, carelessly, negligently, wrongfully, and/or intentionally attempting to collect, collecting or reporting a debt that is not valid and recognized under the law can carry serious legal penalties. Indiana Mortgage Closings may not be used to harass or threaten people and/or companies.

It is your responsibility to confirm that the debt is valid and is recognized under the law before proceeding. Indiana Mortgage Closings must rely upon the accuracy and validity of the information you provide. Indiana Mortgage Closings cannot provide legal advice. Indiana Mortgage Closings does not evaluate or investigate the information you provide to determine whether a debt is valid and recognized under the law. However, Indiana Mortgage Closings reserves the right to decline services regarding any debt it deems inappropriate, inaccurate, and invalid. If you have any questions regarding the accuracy or validity of a debt you are seeking to collect or report, you should immediately consult an attorney. Indiana Mortgage Closings reserves the right to close any account and cease any and all collection efforts, temporarily or permanently, without prior notice to creditor, if it is determined that a viable threat of litigation or actual litigation is contemplated by a debtor or third party such as local, state or federal authorities. As a partial service collection agency, it is our intention to actively participate in the collection process in a meaningful way. Our involvement with the debtor, negotiation of the debt, follow-up with the debtor and/or the creditor is part of our effort to help resolve the account.

Indiana Mortgage Closings provides assistance with collection services only for debts arising from the failure to pay for a Signing Agent service provided by you. Indiana Mortgage Closings will provide collection assistance services for delinquent debts only. In the event that verification is requested, you agree to provide to Indiana Mortgage Closings proof of the debt in the form of - the invoice for the service. In the event you fail to provide verification of a debt within 3 days of a request, all collection assistance services with regard to that debt will immediately cease.

In the event that you receive a notice that a debt is disputed, you are required to immediately notify Indiana Mortgage Closings. In the event that Indiana Mortgage Closings receives notice that a debt is disputed, notification of the dispute will be forwarded to you. Upon receipt of a notice of disputed account from Indiana Mortgage Closings, you will be asked to provide substantiation of the debt within five (5) business days. In the event reasonable substantiation is not received in a timely manner the account will be closed with Indiana Mortgage Closings and all collection assistance will cease.

Better Business Bureau:
If all attempts to collect payment are unsuccessful in obtaining payment from the company, you understand that the information provided by you may be submitted to the Better Business Bureau in the city in which the company operates.

Please note: You may cancel the agreement with Indiana Mortgage Closings at any time.
By using our services, you acknowledge and agree that you are providing accurate information about a valid debt recognized under the law, and will indemnify, defend and hold harmless Indiana Mortgage Closings in connection with any claim or proceeding arising or relating from the information you provide.

Additionally, in the event any litigation arises from or is a result of the use of this website, Signing Agent/Creditor will indemnify, defend and hold harmless Indiana Mortgage Closings and its affiliates, divisions, subsidiaries, officers and employees. This shall include, but not be limited to, litigation or threats of litigation arising from claims made by debtors and/or local, state or federal authorities regarding misinformation provided by creditors, collection agency licensing regulations, debtor claims of offset against creditors and inaccurate or fraudulent information provided by creditors, intentionally or not intentionally.

By using our services, you are acknowledging that you have read and understand the terms and conditions of our collection assistance program.

  1. You understand that Indiana Mortgage Closings provides assistance for collecting unpaid fees for services provide by you.  We are not a collection agency and do not report any information to credit bureaus. 
  2. All fees to Indiana Mortgage Closings must be paid before our services will be rendered.
  3. We do not act as your legal representative but assist with collection efforts to obtain past due payments.
  4. Payments must be past due 60 days from the signing date before Indiana Mortgage Closings will provide assistance.
  5. No refunds of any kind are given.

Services Provided:
Indiana Mortgage Closings will make reasonable attempts to obtain past due payments for you.  We may exercise all or some of the below methods to assist with collecting payment:

  1. Reminder invoices.
  2. Personal phone call(s) to the person/department responsible for Accounts Payable.
  3. Final demand letter (“10 day letter”).
  4. Initiate claim and correspond with the Better Business Bureau regarding the past due payment.
  5. Provide new information regarding your claim to you within (1) business day.

If after exhausting all options listed above and the company has still not issued payment, Indiana Mortgage Closings will have no choice but to cease the collection process.

ALL COMPANIES THAT FAIL TO PAY AFTER ALL COLLECTION ATTEMPTS HAVE BEEN MADE WILL BE PUBLICLY LISTED ON OUR “NO-PAY” LIST TO ASSIST OTHER NOTARIES/SIGNING AGENTS.
